He’s announced he’ll move on guns if the legislature will not. It will hold the force of law until the courts throw it out. More years of fun.

I fully expect an executive action banning the manufacture and sale of "assault " weapons to the general public. I would suspect that that would place that issue squarely in the lap of the SCOTUS.

Shouldn’t be too difficult to obtain a court ordered stay against enforcement of an executive ordered assault rifle ban pending adjudication of the issue. Congress makes the laws, not Joe Biden.

And Joe Biden respects that rule of law.

The previous President tried outlawing bump stocks by declaring them machine guns by BATF regulation.

The 6th Circuit just declared that executive regulatory action unconstitutional, meaning for today, bump stocks are again legal in the 6th Circuit.

The duty of Biden’s Justice Department is to independently assess if they will appeal that ruling.


Biden should stay clear away from that decision.

This should be an interesting Seventh Grade Civics test question in years to come.

But if I had to bet, I’ll bet Biden’s AG will appeal the ruling.

Which will set up a situation where a Republican AG banned a legal firearm part and a Democratic AG will defend it before a conservative Supreme Court, if they grant cert.

As for new executive orders, Biden is considering “ghost guns”, community violence programs, and background checks we already have, where the President clearly has discretion.

Congress makes laws, the President executes those laws, and the Supreme Court plays referee to make sure the law and any executive actions are constitutional, and they usually are.

The reason most are constitutional is that competent lawyers assist the President and the AG serves the Constitution, not Trump or Biden or whoever else is in office.

You are wrong. He wasn't trying to outlaw bumpstocks. He was trying to dupe ignorant gun banners into believing he was outlawing bumpstocks in order to quiet their push for more harmful gun control in the wake of the Las Vegas shooting. Guess what? It worked.

Most intelligent gun owners realized exactly what he was doing and most bumpstock owners kept their bumpstocks because they knew it was still legal to possess them.
