I bought a Benelli Nova last night and I got a "delay" result during the NICS check. :? I'm as 'clean' as they come as far as I can tell. The worst trouble with the law I've been in was to get a few traffic tickets.

Does anyone know why the FBI would not immediately issue "proceed" order?

I gave them my SS#, so I doubt they have me confused with someone else. It's rather annoying to have to wait and wonder what they could possibly have against me. The store said about 40% of their applicants get "delayed" and that it's no big deal. This is the first gun I've bought in about 8 years.

It may be a few things. You may simply not be on file, and a file must be created. It may also be that someone at some point has used your SS# for other than legit purposes.

Or it could be just a simple computer error, at any rate , don't worry about too much.
If the store doesn't hear from them in 72 hours from the time of the call go ahead and pick up your gun.

Thanks guys. As I was reading the posts, the store called and said I could have my gun. :D

The FBI must have just had to open a file on me. A friend of mine bought a new hunting rifle last night too since he couldn't just let me be the only one getting a new toy. He figured he'd worry about explaining to the wife later. :lol: He didn't have a problem getting approved and he's a regular purchaser. The "new file" theory must have been it.

I can't wait to start asking newbie questions about it.

Even with the SS#, you can get a delay if you have a name similar to anyone in NCIS. Also, it depends on how busy the system is at the time. Your buddy may have slipped in during a small window while you got caught up in a time when all lines were busy. I have been delayed myself lasting from a couple of minutes to the next day. It is not a big deal unless you are a ways from home or the shop is out of the way and you need to make a special trip.

Seems to me that I just read in a Department of Justice memo that the nics system has just been turned over to a private company and is no longer done by the fbi.... The memo was asking for feedback about the efficiency of the new system. Mike Orlen

Bingo if your name is John Johnson and some one named Johnny Johnson ever committed a felony.....You get tagged. I got nailed on a wait when I bought a gun after I applied for my CHL, of course they both came back ok, but just the fact that someone some where in time has commited a crime with a name close to yours you can get the waiting period.

it might not have been that they needed to make a file cause i purchased a firearm myself for the first time today and as soon as i filled out the sheet, the guy made the call and was off the phone in about 5 minutes

I've got another question concerning the NICS check. I know that a permit for concealed carry no longer works in place of the NICS, but would a C&R FFL suffice? To my way of thinking, I can get a gun shipped immediately from any gun dealer,anywhere,directly to my door,[provided it meets C&R criteria],with a copy of my license. Yet if I walk into a local gunshop, I could be delayed for three days. Another question;Is it three working days or 72 hours? I recently bought a gun from a pawnshop and waited from Friday to the following Wednesday before they would let me pick up the gun. I think they may have been trying to find a way uot of the sale because they thought it was priced too low. Once the wait was over, and the Feds hadn't responded,they tried to tell me that I had been denied due to the lack of response. If I hadn't thought the price a little low as well, :) , I would have walked out rather than argue the point. BTW, I got the gun.
